These Terms of Service ("Terms") govern your use of the Genesis Life Care website (genesiscare.com.my) and the Genesis Life Care mobile application (the "App"), together the "Services", operated by Genesis Life Care Sdn Bhd ("Genesis Life Care", "we", "our", or "us"). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By visiting our website, enquiring about our services, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our Services. If you are using the Services on behalf of a resident or family member, you confirm you have the authority to do so.
2. Using Our Services
Our website provides information about Genesis Life Care's nursing homes, care services, pricing, and locations, and lets you make enquiries, book a visit, or register interest. The App lets authorised users — residents' families, and our own staff — access care updates, communicate with our care team, and manage centre operations, depending on their assigned role.
3. Accounts & Access
Some features require an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Access to resident care data within the App is restricted by role — family members can only view information for residents they are linked to, and staff access is scoped to their assigned centre and duties.
4. Care Services & Admissions
Enquiries, bookings, and interest registrations made through our website or App do not constitute a confirmed admission or a contract for care services. Admission to a Genesis Life Care centre is subject to a separate admission agreement signed with the relevant care centre, which sets out the specific terms, fees, and conditions of care for that resident.
5. Fees & Payment
Care package fees, rates, and pricing shown on our website are indicative and may vary based on a resident's assessed level of care, and are subject to change. Final fees are confirmed in writing as part of the admission agreement with the relevant centre. Any online payments processed through the App or website are handled via our third-party payment provider and are subject to that provider's terms.
6. Not a Substitute for Emergency Care
Content on our website and App — including care information, guides, and blog articles — is provided for general informational purposes only and is not medical advice. In a medical emergency, always call emergency services or your nearest hospital directly rather than relying on our website or App.
7. Intellectual Property
All content on our website and App — including text, graphics, logos, and the Genesis Life Care name and brand marks — is owned by or licensed to Genesis Life Care Sdn Bhd and protected by applicable intellectual property laws. You may not copy, reproduce, or use our content or branding without our prior written permission, except for personal, non-commercial reference.
8. Acceptable Use
When using our Services, you agree not to:
- Provide false or misleading information in an enquiry, booking, or account.
- Attempt to access accounts, data, or systems you are not authorised to access.
- Interfere with or disrupt the operation of our website or App.
- Use our Services for any unlawful purpose or in violation of these Terms.
9. Limitation of Liability
To the fullest extent permitted by law, Genesis Life Care Sdn Bhd shall not be liable for any indirect, incidental, or consequential damages arising from your use of our website or App. Nothing in these Terms limits our liability for matters that cannot be excluded under Malaysian law, or affects the specific care obligations set out in a signed admission agreement.
10. Termination
We may suspend or terminate your access to the App if we reasonably believe you have breached these Terms, misused the Services, or accessed data without authorisation. You may stop using our Services at any time; this does not affect any separate admission agreement in place for a resident.
11. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of Malaysia.
12. Changes to These Terms
We may update these Terms from time to time. We will note material changes by updating the "Last updated" date above. Your continued use of our Services after changes take effect constitutes acceptance of the revised Terms.
